가. 개요

 

인도는 2001년 기존의 수입 수량규제를 전면 철폐한 이후 수입에 있어 별다른 제한을 가하지 않고 있다. 즉 대부분의 품목이 OGL(Open General License) 대상으로 소정의 절차를 마치면 누구나 쉽게 수입할 수 있도록 하고 있다. 따라서 여타국과 달리 수입에 있어 특별한 제한 조치는 없다고 보면 된다.

 

그 외에 국제적으로 수출입이 제한되고 있는 일부 품목이나, 마약류, 총기류 등 일부 품목과 식품/의약품 등에 대해서는 해당 기관의 승인 및 인증을 받도록 하는 등 일정한 제한을 두고 있다. 인도 표준국 BIS가 요구하는 제품인증이 대표적이며, 식품, 의약품 분야에도 각 관할 기관별 인증을 취득하도록 규정을 두고 있다. 일부 품목의 경우, 2개 이상의 인증을 요청하는 경우도 있기 때문에, 수출시 현지 수입 에이전트, 수입상과 관련 규정에 대해서 확인할 필요가 있다.  

 

나. 비관세 장벽

 

식품에 대한 유효 기간 규정 및 부실한 통관 검사 절차

 

   ㅇ 식품에 대한 까다로운 유효기간 기준

 

수입 당시 식품의 유효 기간은 본래 제품 수명의 60% 이상이 남아있어야 하며, 제품 수명은 제조일과 유효기간 만료일을 토대로 산출하는데 이러한 규정은 인도 국내산 제품과 비교하여 수입산 제품에 대한 차별적인 장애요소로 작용한다.

 

  ㅇ 부실한 항만보건소(PHO:Port Health Officer)의 검사 절차

 

모든 식품 화물은 통관 전에 PHO의 검사를 받아야 하며, 검사 결과 전까지 화물창고에 보관되며, 검사 통과에 실패하면 화물은 반송되거나 폐기 처분된다. 대부분의 식품 통관은 인증 시간이 많이 소요되고, 샘플링 테스트를 위한 실험 시설이 부족해 검사 대기 중인 제품은 유료 보관 창고에 장시간 방치되는 경우도 많으며, 일부 창고는 식품 보관에 적합하지 않은 상태다.

 

검사는 제품 운송 보관의 상태(제품 특성에 따른 보관 요건 충족 여부, 부패와 오염방지 여부 확인)와 제품의 시각적, 물리적 상태(팽창, 돌출 등 식품 변질여부를 가시적으로 판단하며 해충, 먼지 등에 의한 식품 손상을 확인) 등을 확인한다.

 

  ㅇ 샘플검사 절차

 

PHO 검사를 받지 못하는 항만은 해당 항만에서 가까운 중앙식품실험실 또는 보건당국 (Directorate General of Health Service)에서 인가한 실험실에 샘플을 보내 검사를 받아야 한다.

 

샘플 테스트 결과가 나오기까지 1일에서 1개월까지 소요돼 식품 유효기간이 짧아지고 샘플 테스트 비용이 발생하여 수입자에게 이중 부담으로 작용하고 있다.

 

실험실의 검사 결과에 대해 재심을 신청할 수 있으나, 검사 기간에 대한 규정이 없고, 제품을 명확하게 구분하지 않아 잘못된 기준으로 검사를 실시하는 경우도 발생한다. 식용유와 유지, 콩류, 시리얼 제품, 분유, 연유, 색소성분 및 첨가물은 필수적으로 샘플 테스트를 거쳐야 한다.

 

2011년 8월 FSSA의 시행 후 기존보다 1개 추가된 4개 샘플로 변경하여 수집하고 있으며, 1개 샘플은 식품 분석가에게 전달되고, 2개 샘플은 FSSAI가 지정한 관리자, 나머지 1개는 업체 요청 시 정부가 승인한 샘플 실험실로 전달된다. 이 때, 식품 분석가와 실험실의 테스트 결과가 상이할 경우 최종 심사를 위해 제 3의 실험실로 전달 후 분석된 결과로 판정된다. 

 

FSSA의 시행으로 새로운 조정 절차가 추가되었는데, 분석 결과가 기준에 부합되지 않을 경우, 검사 판정에 대한 조정 신청이 가능하며, 주정부에 의해 임명된 관리자가 조정 절차를 주재한다. 식품 안전 항소 재판소는 법원과 동등한 권한이 부여되므로 심각한 위반 사례에 한해 실제 법적 절차를 밟을 수 있다. 이로 인해 법정 분쟁 사례가 현저히 줄어들고 판결 절차가 간소화됐다.

라벨링 규정의 확대 적용

 

소매를 목적으로 인도에 수입되는 모든 제품들은 Standard of Weights and Measures Rules의 조항들을 준수해야 하며, 다음 사항들을 명시해야 한다.

 

  - 수입자명과 주소

  - 포장된 제품의 일반적인 명칭

  - 표준 단위로 표기된 총수량

  - 제품의 포장연월

  - 포장된 형태로 최종 소비자에게 판매되는 최고 소매가

    (세금, 운송비, 수수료, 광고비, 운송비 등 모두 포함)

  - 수입국(Source of Import)

  - (식품이나 화장품의 경우) 유효 기간

 

통관 전 루피화로 표시된 최고 소매가(Maximum Retail Price, MRP)를 라벨에 명시하는 것은 對 인도 수출업자들에게 부담으로 작용하는데 라벨에 명시된 제품 가격은 세금 산출 근거로 활용된다. 대부분의 경우 판매업자들은 최고가를 실판매가로 간주하기 때문에 정확한 최고가 예측이 중요하다. 한번 정해진 MRP는 수정할 수 없으며, 가격을 인상하기 위해서는 새로운 통관 물량부터 인상이 가능하다.

 

세관에서의 수출품 재반출 거부

 

바이어의 구매 거부로 인한 수출품 재반출을 세관에서 거부하는 사례가 빈번히 발생 한다. 운송된 제품에 대해 바이어가 이런저런 사유로 구매를 거부할 경우, 수출자는 제3의 바이어에게 판매하거나 아니면 수출지로 재반출해야 하나, 이 경우 인도 세관에서는 원래 계약자(바이어)의 NOC(Non Objection Certification)을 요구하게 된다. 

 

하지만 바이어가 이러한 점을 악용해 NOC를 써 주지 않을 경우, 재반출이 불가하게 된다. 현지 바이어가 이런 현실을 악용하여 시장 상황에 따라 구매를 거부한 후, 수출자의 재반출이 곤란해진 틈을 이용해 재협상을 시도하여 유리한 조건으로 물품을 인도받는 경우가 종종 있다.

 

중고 자동차 수입규제

 

인도 정부는 중고 차량 수입 시, 중고 차량의 연수가 제조일로부터 3년이 넘지 않고, 이륜차 및 삼륜차를 제외하고 모든 중고 차량의 운전자석은 오른쪽에 위치해 있는 차량만 수입이 가능하도록 규정하였다. 자동차 내 미터기는 킬로미터로 표기되어 있어야 하며, 중고차량 수입은 모두 뭄바이 세관(Customs Port at Mumbai)을 통해 이루어져야 한다.

 

중고 차량은 인도로 수출할 경우 별도의 테스트도 거쳐야 하며 이는 수출 및 선적전에 완료해야 한다. 테스트는 중앙정부에서 고시하는 시험 인증기관을 통해 받을 수 있는데, the Vehicle Research and Development Establishment, Ahmednagar of the Ministry of Defence of the Government of India, Automotive Research Association of India, Pune or Central Farm Machinery Training and Testing Institute(트렉터) 등이 속한다.

이 외 배기량 제한도 있는데, 수입하는 중고 자동차 배기량은 3,000cc를 넘어야 하며 1000cc-2500cc의 중고 차량은 전면 수입이 금지되어 있다. 이륜차의 경우 스쿠터는 50cc-500cc 사이의 모델은 수입 가능하며, 모터사이클은 250cc 이상의 모델에 대해 수입이 가능하나 800cc를 넘길 수 없다.
